Under the Indian Patent Act, 1970 has two aspects- The first being the owner of the patent having a statutory right for a certain length of time and Secondly, that the patentee has to disclose all the material information related to his/her innovation in detail so that a person who is conversant with the technology can practice that invention and exploit the invention to its full use.

The Highlights of The Patents Act, 1970

  • To codify inventions which are non patentable.
  • Patents can be granted for processes, methods, manufactures but not substances per se, in respect of inventions relating to Food, Drugs and medicines, or to substances prepared or produced by chemical processes
  • The period of validity of the patent of process relating to food, medicine and drug is 5 years from the date of sealing of patent or seven years from the date of patent, whichever is shorter. In other cases it is 14 years.
  • It provides for compulsory licences under certain circumstances.
  • It provides for use of patented inventions for purposes of Government and acquisition of inventions by the
    Central Government.
  • Revocation of patents in public interest.
